1. Agreement to Terms

These Terms & Conditions constitute a legally binding agreement between you and VanGuard. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you must discontinue use immediately.

2. About VanGuard AI LLC

VanGuard is operated by VanGuard AI LLC, a limited liability company organized under the laws of the State of North Carolina, USA ("VanGuard," "we," "us," or "our"). VanGuard provides AI-powered fitness scoring, analytics, ASVAB study tools, administrative paperwork drafting assistance, and career progression tools. The service includes AI chat assistance, physical training (PT) calculators, profile management, and related features.

3. Account & Eligibility

You must be at least 18 years old or have the authority to bind your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information and keep it updated.

4. Acceptable Use

You agree not to misuse the service, including but not limited to:

• Using the service for any unlawful purpose or in violation of any applicable laws
• Engaging in fraud, spam, or deceptive practices
• Infringing on intellectual property rights of others
• Attempting to interfere with the security or integrity of the service, including malware distribution, probing, or scraping
• Reverse engineering, circumventing technical limits, or reselling/redistributing access
• Submitting any AI-generated text from VanGuard as an official military document, record, counseling, evaluation, award citation, leave request, or correspondence with the chain of command. All writing-practice output is sample text for study only and must be rewritten in your own words and approved through your chain of command before any real use.
• Entering real personally identifiable information (PII), Social Security Numbers, EDIPIs, real unit-identifying information, controlled unclassified information (CUI), or classified information into any input field
• Cheating, or attempting to cheat, on the actual ASVAB or any other proctored examination — VanGuard is a study aid only
• Impersonating any service member, veteran, government official, or recruiter
• Falsely representing VanGuard, its outputs, or any third party as affiliated with or endorsed by the U.S. military

4a. No Government Affiliation

VanGuard and VanGuard AI LLC are independent of, and not affiliated with, endorsed by, or sponsored by the U.S. Department of Defense, the U.S. Army, the U.S. Marine Corps, the U.S. Navy, the U.S. Air Force, the U.S. Space Force, the U.S. Coast Guard, or any other U.S. federal, state, or local government agency. References to branch names, ranks, MOS codes, form numbers (e.g., DA Form 4856, NAVMC 118(11)), doctrinal publications (e.g., ADP 6-22, MCO 1400.32), and scoring standards (e.g., ACFT, PFT, PRT) are used solely for educational and informational purposes. All trademarks and service marks are the property of their respective owners.

5. AI-Generated Content & Acceptable AI Use

VanGuard uses generative AI to provide responses, analytics, study questions, and drafting assistance. You are solely responsible for your prompts, for verifying the accuracy of outputs before relying on them, and for ensuring you have the rights to any content you submit as input.

You must NOT use the AI features to generate, request, or distribute:

• Deepfakes, non-consensual intimate imagery, or content impersonating real individuals without consent
• Hate speech, harassment, threats, or content that incites violence against any person or group
• Sexual content involving minors, or any child sexual abuse material (CSAM)
• Malware, exploits, phishing kits, or instructions for committing crimes or causing physical harm
• Content that infringes the intellectual property, privacy, or publicity rights of others
• Prompts or techniques intended to jailbreak, bypass safety filters, or extract system instructions from the underlying models
• Classified, controlled-unclassified (CUI), or operationally sensitive military information

Moderation & Takedowns. We reserve the right (but have no obligation) to monitor, filter, remove, or restrict content and to suspend or terminate accounts for repeated or serious misuse. If you believe content on the service infringes your intellectual property rights, send a notice to support@vanguarda.life with: (a) identification of the copyrighted work, (b) the location of the allegedly infringing content, (c) your contact information, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act. We terminate accounts of repeat infringers.

6. No Professional Advice

Nothing on VanGuard constitutes professional advice. All content, tools, calculators, AI outputs, study materials, and documents generated through the service are provided for general informational and educational purposes only.

VanGuard explicitly disclaims providing any of the following:

• Financial or investment advice — including retirement planning, TSP allocations, savings strategies, or portfolio recommendations
• Legal advice — including interpretation of military law, UCMJ, administrative proceedings, or civilian legal matters
• Medical or mental-health advice — including diagnosis, treatment recommendations, or fitness-for-duty assessments
• Career or official military guidance — AI outputs do not constitute official guidance from the U.S. Department of Defense, any branch of the U.S. Armed Forces, or any government agency
• Tax advice — including tax filing strategies, deductions, or compliance recommendations

Always consult a qualified professional — such as a licensed financial advisor, attorney, physician, certified tax professional, or your chain of command — before making decisions based on information obtained through VanGuard. Reliance on any information provided by VanGuard is solely at your own risk.

7. Intellectual Property & Your Content

VanGuard retains all ownership rights to the service, software, documentation, models, prompts, and branding. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service within the scope of your selected subscription plan.

You retain ownership of the content you submit to the service ("User Content"). You grant VanGuard a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your User Content solely to the extent necessary to operate, secure, support, and improve the service for you. You represent that you have all rights necessary to grant this license.

8. Service Level

We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. The service is provided on an "as is" and "as available" basis.

9. Payments, Billing & Subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel at any time; you will retain access until the end of your current paid period.

10. Suspension & Termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the service ceases immediately.

11. Disclaimers & Liability

To the fullest extent permitted by law, VanGuard disclaims all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the total fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages. Nothing in these terms excludes liability for fraud, death, or personal injury where required by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless VanGuard AI LLC, its officers, members, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content, (b) your use or misuse of the service, (c) your violation of these Terms, or (d) your violation of any applicable law or third-party right.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict-of-law principles. Subject to the informal-resolution step below, you and VanGuard AI LLC agree that the state and federal courts located in Mecklenburg County, North Carolina shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, and you consent to personal jurisdiction and venue in those courts.

Before filing any claim, you agree to first contact us at support@vanguarda.life and attempt to resolve the dispute informally for at least 30 days.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the revised Terms.
